Questions
Frequently asked questions
What is the limitation period for a contract claim in Bulgaria?
The general period is five years (Art. 110, Obligations and Contracts Act). Rent, interest and other periodic payments, and penalties and damages for breach of contract, become time-barred after three years (Art. 111). The period runs from the date the claim falls due and is interrupted, for example, by acknowledgement of the debt or by filing a claim.
How can I recover a debt in Bulgaria without a full lawsuit?
Order-for-payment proceedings are the faster route. The court issues an order for payment on the creditor’s application (Art. 410, Civil Procedure Code). With certain documents, such as a promissory note or a notarial deed, it also orders immediate enforcement (Art. 417). If the debtor does not object in time, the order becomes final.
I have been served with an order for payment. What should I do?
File a written objection within two weeks of service (Art. 414, Civil Procedure Code). If you object, the court instructs the creditor to bring a claim within one month, or the order is set aside (Art. 415). Keep the date of service: a missed deadline can rarely be restored.
Do I need a notarial deed to buy property in Bulgaria?
Yes. Transfers of ownership and the creation of property rights in real estate require a notarial deed (Art. 18, Obligations and Contracts Act). A preliminary contract is made in writing, and if the other side refuses to complete, a court can declare it final (Art. 19). Restrictions on owning land apply to some foreign buyers, so check this before signing.
What is the deadline to appeal a civil judgment?
Two weeks from service of the judgment, filed through the court that delivered it (Art. 259, Civil Procedure Code).
Can I work with you in English?
Yes. Consultations, correspondence and contract drafting can all be in English. Court proceedings in Bulgaria are conducted in Bulgarian, and foreign-language documents are filed with a translation.
