Tax law
The tax side of a deal before it is signed, and defence when the revenue administration challenges it. A contract has a commercial side and a tax side, so the two are reviewed together. Miroslav Mavrov works with Bulgarian and international clients, in English and in Bulgarian.

Questions
Frequently asked questions
How long does a National Revenue Agency tax audit take?
As a rule, up to three months from service of the audit order, and the period can be extended (Art. 114, Tax and Social Insurance Procedure Code). The audit ends with an audit report, to which you can file a written objection and evidence within 14 days (Art. 117). The objection is the first chance to change the outcome before the assessment is issued.
How do I appeal a tax assessment act?
Within 14 days of service, to the director of the Appeals and Tax and Social Insurance Practice Directorate at the NRA central office, filed through the authority that issued the act (Art. 152). The director’s decision can then be appealed to the administrative court (Art. 156). An act that was not appealed administratively cannot be taken to court.
When must a business register for VAT in Bulgaria?
When its annual turnover in Bulgaria exceeds EUR 51,130 (Art. 96(1), VAT Act). The application is due within 7 days of exceeding the threshold (Art. 96(6)), and the business counts as registered from the following day (Art. 103). Voluntary registration below the threshold is also possible (Art. 100).
Do I charge Bulgarian VAT on services to a business in another EU country?
Generally not. For services to a taxable person, the place of supply is where the customer has established its business (Art. 21(2), VAT Act), and the customer accounts for the VAT. There are exceptions, such as services connected with real estate in Bulgaria.
What expenses can a self-employed professional deduct?
Without receipts, statutory expenses of 25 per cent of the income are recognised (Art. 29, Personal Income Tax Act), and the tax on the annual base is 10 per cent (Art. 48). Social security contributions are paid separately as a self-insured person.
When is the best time for a tax review of a deal?
Before signing. At that point the structure, price and clauses can still change so that VAT, corporate tax and tax on payments abroad are predictable. After signing, what remains is mostly defence in an audit.
